Texas State Legislature

Jessica Ferrar, a Texas State Legislature, has introduced HB 3318.  This bill would ... well read the text of the bill: (Via LoneStarTimes)

SECTION 2. Chapter 19, Penal Code, is amended by adding Section 19.08 to read as follows:

Sec. 19.08. INFANTICIDE. (a) A person commits an offense if the person wilfully by an act or omission causes the death of a child to whom the person gave birth within the 12-month periodpreceding the child ’s death and if, at the time of the act or omission, the person ’s judgment was impaired as a result of the effects of giving birth or the effects of lactation following thebirth.

(b) An offense under this section is a state jail felony.
I'm really surprised it's not called the Andrea Yates bill yet, or Yates Children Bill or something.

I'm not sure I like this.  While post-partum depression is very, very real I just still think that they should be tried for murder as ... well that's what they've done.  We already have insanity pleas, don't we?  And this new bill could shorten the jail sentence to 180 days.  180 days?  For murdering a baby?

And the article above goes on to talk about how Andrea Yates was misunderstood.  Yeah, well yes.  But post-partum was only part of the issue there.  She was bat crazy anyway and was a member of a should be called cult.  So let's not think that post-partum turned a perfectly normal person into a ravving murder, all on it's own.  There were obviously other mental issues there.  Which is why she's in a mental institution and not a jail cell.

Seriously.  If I murdered my children and was out of jail 180 days later, the court wouldn't need to do anything ... my husband would kill me.

Which brings up another point ... what about the rights of the other victim here, the father?

As to the abortion angle ... I dunno.  I can't make that jump.  Maybe I'm missing something, but I just don't see how this could have a reaching impact there.  But what do I know.

But Ferrar is a professed Catholic that attends the same church as the author of the post over at LoneStar.  That her church serves her communion based on this and her other views is amazing to me.
